Terms of Service

Hibiki — Streamer Studio ("Hibiki", the "Service") is a Windows streaming companion offered under the Risefall name ("we", "us", "our"). It brings together supported live chats and events, optional text-to-speech and AI-assisted utilities, OBS/browser-source widgets, moderation, stream notes, music controls and related features.

These Terms apply to the desktop software, website, hosted account and platform-integration services. Separate rules may apply to software distributed by Steam or Microsoft Store and to billing transactions through Paddle or another payment provider. By installing, registering for or using Hibiki, you agree to these Terms and acknowledge our Privacy Policy. If you are using Hibiki for an organization, you confirm you have authority to act for it.

If you do not accept these Terms, do not use Hibiki or connect third-party services. Questions: support@risefall.org.

You must be legally permitted to enter this agreement and meet the minimum age and account rules of each service you connect. You must provide accurate information when required, maintain lawful access to your connected channels, secure your device and accounts, and promptly report compromised credentials.

Accounts may use Google, Steam or other supported identity providers; each sign-in identity may correspond to a separate Hibiki account unless we explicitly provide an account-linking feature. You are responsible for account activity, authorized moderators, settings and content published or transmitted through the software. You must not transfer, share or resell access in violation of the applicable plan or provider terms.

Subject to compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use an authorized copy of Hibiki for its intended purposes. The license is not a sale of source code, branding, or underlying intellectual property. Risefall and its licensors retain their respective ownership rights.

Do not remove attribution, distribute altered or malicious installers, bypass entitlement enforcement, reverse engineer restricted components except where non-waivable law permits, or use our marks to suggest approval. Independent logos, trademarks, stream content and platform assets remain owned by their respective rights holders. The use of YouTube branding does not imply that YouTube sponsors or endorses Hibiki.

Hibiki may offer a free tier alongside paid features, which may include enhanced voice or AI functionality, customization, streaming workflows or additional moderator capabilities. YouTube API connectivity and access are not themselves sold by Hibiki; paid fees apply to Hibiki’s own additional software functionality and supporting infrastructure, as described at checkout.

Feature limits, supported platforms, system requirements, available integrations and plan entitlements may evolve. A preview or "Coming soon" label does not promise a particular release date. We may add, update, discontinue or restrict features for compatibility, safety, security, licensing, provider or legal reasons. When required by law or a binding paid offer, material adverse changes will be handled with appropriate notice and remedies.

Paid access may be billed as a recurring subscription. Prices, currency, renewal frequency, taxes, trial conditions, usage limits and the effective seller of record are shown before purchase by the applicable checkout provider. Depending on how you obtained Hibiki, billing may be processed by Paddle or a supported storefront such as Steam. We do not require full payment card numbers in our own app database.

Unless stated otherwise at checkout, recurring subscriptions renew until canceled. You are responsible for canceling through the applicable provider before renewal. Deleting the desktop app, removing a connected YouTube account or requesting Hibiki account deletion does not necessarily cancel a separately managed subscription; confirm cancellation in your payment provider’s account portal. Paid feature access may end after the paid period or when a charge fails or is reversed.

Refunds, cooling-off and consumer rights are governed by our Refund Policy, the applicable provider’s checkout terms and any mandatory consumer protection law. Nothing in these Terms removes statutory cancellation, warranty or refund rights that cannot be waived.

Hibiki uses YouTube API Services. By accessing or using YouTube functionality through Hibiki, you also agree to be bound by the YouTube Terms of Service. Our YouTube integration operates under the YouTube API Services Terms of Service, applicable developer policies and Google’s authorization rules. Google Privacy Policy explains Google’s handling of personal information.

You authorize only the permissions shown and granted during Google’s consent flow. You remain responsible for your own channel, messages, moderators, audience interaction, applicable YouTube policies and any actions you request Hibiki to perform. Hibiki may display YouTube livestream status, chat, membership/paid events and controls permitted by your account and API scopes. A feature that sends, removes, hides or otherwise changes content on YouTube should be undertaken only with the authorizing account’s permission and applicable user confirmation. Do not use Hibiki to manipulate engagement, automate abuse, spam, circumvent provider quotas or access another channel without authorization.

YouTube may change or suspend API functions, impose quota limits or revoke permissions independently of Hibiki. We cannot guarantee its uptime or quota decisions. Hibiki is an independent streaming utility, not an official YouTube product. You can revoke access through Google’s security permissions page and follow our YouTube data deletion instructions.

Twitch, TikTok, Spotify, YouTube-based playback and any other connected service remain subject to the provider’s own terms, API requirements, eligibility, content rules and regional availability. An integration may be introduced, paused or disabled when third-party access changes.

You must have rights to the materials you play, transmit or display. A music playback connection does not grant public performance, synchronization, rebroadcast or other music licensing rights. You are responsible for any licenses required by your jurisdiction, broadcaster status and platform. Streaming software cannot replace a provider’s required authorizations or guarantee continued access to third-party media.

Hibiki may receive messages, user names, roles, event signals and other information from streaming services you connect. You decide which data and events to view, speak aloud, display as an overlay or send to moderators. You are responsible for the commands you issue, the people you authorize and how displayed content affects third parties.

Browser-source and OBS widget URLs, moderator links and API credentials are sensitive access mechanisms. Keep them private, rotate compromised access and avoid posting them publicly. Moderation features are tools, not guarantees against harassment, spam, copyright violations or offensive speech. Controls that hide content from widgets or TTS may not hide or delete it from the underlying streaming platform.

Users must not use Hibiki to harass, impersonate, dox, surveil, discriminate against or exploit others. You must respect a viewer’s and moderator’s rights and applicable privacy laws when exporting, distributing or retaining conversations.

Optional AI and text-to-speech features may involve automated processing of prompts, stream messages and other text by Hibiki infrastructure or third-party providers. Output can be delayed, inaccurate, inappropriate or incomplete and requires your judgment. You should review public-facing settings and moderation filters before enabling autonomous announcements or speech on stream.

You are responsible for ensuring you have a lawful basis and any necessary notices or permissions before submitting others’ personal data, copyrighted text or sensitive material to these features. Do not use generated voices or content to impersonate a person without authorization, deceive an audience, facilitate abuse or violate another party’s rights. Feature quotas and limits are described in the app or at purchase and may change prospectively under the applicable plan.

You agree not to:

• violate laws, provider rules, intellectual-property rights, privacy rights or others’ safety;
• obtain credentials or API data for someone else’s account without authority;
• transmit malware, attack infrastructure, bypass security, evade technical rate limits or distribute unauthorized modified copies;
• use unauthorized scraping or undocumented platform APIs where the provider prohibits it;
• misuse chats, moderation functions, memberships or paid-message events to send spam, manipulate engagement or harass people;
• resell third-party API access, content or YouTube playback as a separate paid service;
• interfere with service operation, defeat billing checks or use Hibiki for fraudulent activity.

We may investigate credible security or abuse reports and restrict an account or feature where reasonably necessary, subject to applicable law and any promised review process.

You retain rights you have in material you lawfully create. To operate Hibiki, you authorize us to process the content and metadata necessary to provide the features you enable, as described in the Privacy Policy. You grant no blanket license to commercially exploit private stream chat or connected-platform data for unrelated purposes.

You are responsible for the lawful origin of content supplied by you or your stream participants, the settings used to publish it and your locally exported data. See the Privacy Policy’s YouTube API section and the data retention section. You can request account and data deletion; deleting Hibiki data does not delete content held independently by YouTube or other services.

We strive to maintain reliable operation and appropriate safeguards, but software, internet connections, third-party APIs, device settings and OBS integrations can fail. You should keep backups of notes and settings you need, install updates from authorized channels and maintain separate access to the official streaming platforms in case of an outage.

Maintenance, upgrades, provider outages, quota exhaustion, compatibility changes, malware attacks or other causes may temporarily limit services. We may deploy updates, security restrictions or emergency suspensions when necessary, with notice when practical and required.

You may stop using Hibiki, disconnect integrations and request deletion of your account. Subscription cancellation must also be handled with the applicable merchant or storefront. We may suspend or terminate access for serious breaches, fraud, security risk or legal requirements, proportionately and subject to mandatory protections. Termination does not automatically erase records we are legally required to preserve.

For deleting a Hibiki account and data, see Account & Data Deletion. You can separately revoke YouTube authorization through Google account permissions. A disconnection from Hibiki cannot remove a user’s YouTube channel or erase data stored on YouTube’s own servers.

To the maximum extent permitted by applicable law, Hibiki is offered "as is" and "as available". We do not guarantee uninterrupted or error-free operation, universal compatibility, a specific number of API requests, platform approval, an audience size, streaming revenue or business results. Advice, summaries, AI output and moderation controls are assistive features and should not be solely relied upon for critical decisions.

Third-party services are controlled by their respective operators. Nothing here limits warranties or service obligations that mandatory consumer law requires. Provider-specific outages or policy decisions do not necessarily constitute a breach by Hibiki.

To the extent permitted by applicable law, neither Risefall nor its service providers are liable for indirect, incidental, special, consequential or punitive losses, including lost revenue, audience, data or business opportunity, arising from Hibiki’s use, interruption or integration failures. Subject to non-waivable law, our aggregate liability for a claim relating to paid Hibiki services will not exceed the amount paid for the affected Hibiki service during the 12 months preceding the event, or the mandatory legal minimum if greater.

These limits do not exclude or restrict liability for fraud, willful misconduct, gross negligence where prohibited, injury, or any statutory consumer or privacy right that cannot legally be limited. The above allocation of risk is part of the pricing of the service.

To the extent enforceable under applicable law, you are responsible for claims caused by your unlawful content, unauthorized moderation instructions, infringement of others’ rights or material breach of these Terms. This provision does not shift to you losses caused by our own unlawful conduct or remove non-waivable consumer protections.

We may revise these Terms to reflect law, platform API requirements, operational changes or feature development. A revised version will be published with an updated date. Where a change materially reduces paid rights or requires express agreement under law, we will provide notice and, where required, appropriate options before applying it. Continued use after a lawful effective change may constitute acceptance where permitted.

Applicable consumer-protection, data-protection and other mandatory laws continue to apply regardless of these Terms. Disputes should first be raised with support@risefall.org, with a description of the issue and the resolution you seek. Any governing-law or jurisdiction provision must be consistent with the actual contracting entity, checkout seller of record and non-waivable consumer rights; we do not designate a court or jurisdiction here without verified operator details.

Nothing limits your ability to contact a regulator, seek statutory remedies or use an applicable alternative-dispute-resolution mechanism.
